Terms and Conditions
1. Introduction
These Terms & Conditions (“Terms”) govern the use of the Stoke Films website and any engagement with Stoke Films (“we”, “us”, “our”) for the provision of video production, photography, creative services and related work.
By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, you should not use our website or services.
2. Services
Stoke Films provides creative production services including (but not limited to) video production, photography, editing, pre-production planning, creative direction and post-production services.
All services will be delivered in accordance with a written proposal, quote, email confirmation and/or production agreement agreed between Stoke Films and the client (“Client”).
3. Quotes and Scope of Work
All quotes are valid for a limited time as stated in the proposal and are based on the information provided by the Client at the time of quoting.
Any changes to scope, including but not limited to additional filming days, revisions, locations, or deliverables, may result in additional costs. These will be agreed with the Client prior to proceeding.
4. Booking and Confirmation
A booking is confirmed once the Client has accepted a quote or proposal in writing (including email acceptance) and, where applicable, paid any required deposit.
Stoke Films reserves the right to reschedule or decline work due to availability, weather conditions, safety concerns or unforeseen circumstances.
5. Payment Terms
Unless otherwise agreed in writing:
- A deposit may be required to secure a booking
- Late payments may incur additional fees and/or suspension of delivery
All prices are exclusive of GST unless stated otherwise.
6. Cancellations and Rescheduling
If a Client cancels a confirmed booking:
- Deposits may be non-refundable to cover time, planning and pre-production costs
- Cancellations within a short timeframe of the shoot date may incur additional charges
- Any third-party costs already incurred (e.g. crew, travel, locations, equipment hire) may be payable by the Client
Rescheduling is subject to availability and may require adjustment of costs.
7. Client Responsibilities
The Client agrees to:
- Provide accurate information and materials required for the project
- Obtain all necessary permissions, consents, and location access unless otherwise agreed
- Ensure timely feedback and approvals to avoid delays
Stoke Films is not responsible for delays caused by missing information, approvals, or access issues outside our control.
8. Intellectual Property
Unless otherwise agreed in writing:
- Stoke Films retains ownership of raw footage, project files and unused material
- Final delivered content is licensed to the Client for agreed usage purposes upon full payment
- Stoke Films reserves the right to use completed work for portfolio, marketing and promotional purposes
9. Usage Rights
Delivered content may not be altered, resold or redistributed beyond agreed usage terms without prior written consent.
Extended licensing or additional usage rights may be available upon request.
10. Third-Party Costs
Any third-party expenses (including but not limited to music licensing, stock footage, actors, locations, travel and equipment hire) will be charged to the Client unless explicitly included in the quote.
11. Limitation of Liability
Stoke Films will take reasonable care in delivering all services but is not liable for:
- Indirect or consequential loss
- Loss of business, revenue, or opportunity
- Delays caused by weather, technical issues, or external factors
- Circumstances beyond reasonable control
12. Force Majeure
Stoke Films is not liable for failure to perform services due to events outside reasonable control, including but not limited to natural disasters, illness, government restrictions, or equipment failure.
13. Website Use
All content on this website is owned by or licensed to Stoke Films and may not be copied, reproduced, or used without permission.
We do not guarantee that the website will be error-free or continuously available.
14. Privacy
Any personal information collected through our website or services will be handled in accordance with applicable New Zealand privacy laws and used only for legitimate business purposes.
15. Changes to Terms
Stoke Films may update these Terms at any time. Continued use of our website or services after changes are published constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
